Terms of Service

1. Acceptance of Terms

By accessing or using MyHomeStand (“the Service”), operated by MyHomeStand (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service. We reserve the right to update these Terms at any time. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Description of Service

MyHomeStand is a web-based platform designed to help youth sports leagues (primarily Little League baseball) manage clubs, teams, rosters, schedules, communications, snack duties, and fee collection. The Service is provided “as is” and is intended for use by club administrators, coaches, and parents/guardians of participating players.

3. Account Registration and Responsibilities

You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. Children’s Data and Parental Consent

MyHomeStand does not knowingly collect personal information directly from children under the age of 13. Information about minor players (such as name, date of birth, jersey number, allergies, and emergency contact information) is provided exclusively by parents/guardians or authorized club administrators and coaches. By providing a child’s information through the Service, you represent and warrant that you are the child’s parent or legal guardian, or an authorized representative of the organization acting with parental consent, and that you consent to the collection and use of such information as described in these Terms and our Privacy Policy.

If we learn that we have collected personal information from a child under 13 without verifiable parental consent, we will take steps to delete that information promptly. If you believe a child’s information has been submitted without proper consent, please contact us at support@myhomestand.com.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
  • Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.
  • Attempt to gain unauthorized access to any portion of the Service, other accounts, or any systems or networks connected to the Service.
  • Upload or transmit any viruses, malware, or other harmful code.
  • Use the Service to send unsolicited bulk communications (spam).

6. Payments and Fees

MyHomeStand facilitates fee collection between clubs and parents/guardians through Stripe, a third-party payment processor. Clubs set their own fee amounts, due dates, and descriptions. We do not control, and are not responsible for, the fees charged by any club.

Payment processing is handled entirely by Stripe. MyHomeStand does not store credit card numbers or sensitive financial information on its servers. By making a payment through the Service, you agree to Stripe’s Terms of Service and Privacy Policy.

Refund policies are determined by individual clubs. MyHomeStand is not responsible for issuing refunds for club fees. Please contact your club administrator directly regarding any refund requests.

7. Subscription and Platform Fees

Club administrators subscribe to MyHomeStand at the pricing listed on our website. We reserve the right to change pricing with reasonable advance notice. Continued use of the Service after a pricing change takes effect constitutes acceptance of the new pricing.

8. Intellectual Property

All content, features, and functionality of the Service (including but not limited to text, graphics, logos, and software) are the exclusive property of MyHomeStand or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any portion of the Service without our prior written consent.

You retain ownership of any content you submit to the Service (such as club names, player information, and messages). By submitting content, you grant us a limited, non-exclusive license to use, store, and display that content solely for the purpose of providing the Service.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MYHOMESTAND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless MyHomeStand and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination and Suspension

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Texas, and you consent to the personal jurisdiction of such courts.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
